    摘要:

    高校教师聘任制在现代大学制度中具有重要的价值诉求。目前,地方高校教师聘任制遭遇一系列困境:制度因利主体合力抵制而流于形式化,合同因法律性质不明确而缺乏可预测性,考核评价因行政主导而趋于功利化,主体及程序因在瑕疵而影响合法性。深化改革,需要从法治化视角对教师聘任制进行全方位重构:立法上完善相关法律法规体系,执法强化高校依法行政要求,司法上畅通当事人权利救济渠道,守法上塑造利益主体法治精神。

    Abstract:

    The appointment system of university teachers has an important value demand in the modern university system. Howev- r,at present,the appointment system of teachers in local colleges and universities has encountered a series of difficulties: the system formalized due to the resistance of the interest subjects,the contract is lack of predictability due to the unclear legal nature,the as- essment and evaluation tend to be utilitarian due to the administrative guidance,and the subject and procedures affect the legality due the defects. In order to deepen the reform,we need to reconstruct the teacher appointment system from the perspective of the rule of w: to perfect the relevant laws and regulations system in legislation,to strengthen the administrative requirements in accordance with e law in law in law enforcement,to unblock the channels of the parties’rights relief in judicature,and to shape the spirit of the rule f law in the interest subjects.
